Terms of Service

1. Acceptance of Terms

By accessing or using the SurgeVA website or services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Services

SurgeVA provides managed virtual assistant outsourcing services. We source, vet, onboard, manage, and compensate virtual assistants on behalf of our clients. Service terms, including scope, deliverables, and pricing, are outlined in individual client agreements.

3. Client Responsibilities

Clients are responsible for providing clear direction and timely feedback to virtual assistants, maintaining a professional and respectful working environment, and complying with all applicable laws in their use of VA services. Clients may not direct VAs to engage in illegal, unethical, or fraudulent activities.

4. Intellectual Property

Work product created by virtual assistants under client direction and paid for by the client is owned by the client, subject to the terms of the individual service agreement. SurgeVA retains ownership of its own proprietary processes, methodologies, and systems.

5. Limitation of Liability

To the maximum extent permitted by applicable law, SurgeVA shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability in connection with any service shall not exceed the fees paid in the three months preceding the claim.

6. Termination

Either party may terminate services with 30 days written notice. SurgeVA reserves the right to suspend or terminate services immediately if a client breaches these terms or engages in abusive or illegal conduct.

7. Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Suffolk County, Massachusetts.

2. Message Frequency

Message frequency will vary depending on your engagement with SurgeVA and the nature of your inquiry or service. Typical message frequency is 2–6 messages per month. You will not receive unsolicited promotional messages after opting out.

3. Message and Data Rates

Standard message and data rates from your mobile carrier may apply to all SMS messages sent and received. SurgeVA does not charge for SMS communications, but carrier fees may apply.

4. Opting Out

You may opt out of receiving SMS messages at any time by replying STOP to any message from us. After opting out, you will receive a one-time confirmation message and no further SMS messages. To re-subscribe, reply START or contact us directly.

5. Help and Support

For help with SMS communications, reply HELP to any message or contact us at support@surgeva.com or (617) 212-6748. We will respond to your inquiry within 2 business hours.

6. Privacy

Your mobile number and SMS opt-in data will not be shared with or sold to third parties for marketing purposes. It will only be used for the communications you have consented to. See our Privacy Policy above for full details on data handling.
